The election of members of the AUCIL is governed by the provisions of the AUCIL Statute and the Rules of Procedure of the Executive Council. The AUCIL was established as an advisory organ of the African Union in accordance with Article 5(2) of the Constitutive Act of the African Union. The AUCIL consists of eleven members who are nationals of Member States who have recognized competence in international law. The AUCIL cannot have more than one national from the same State, as per Article 3(2) of the Statute. Members of the AUCIL are elected by the Executive Council through a secret ballot for a term of five years and are eligible for re-election only once, based on Articles 11 and 12(2) of the Statute.
